SPECIAL LOW RATES

(ANYTHING UNDER $60/HR.)

FOR CONSULTING FIRMS

(COMPANIES GET EVEN LOWER RATES)

BEFORE YOU READ ABOUT MY SPECIAL LOW RATES, YOU MAY WANT TO LEARN ABOUT MY REGULAR RATES AND MY “BELOW AVERAGE” RATES. NOTE THAT MY OTHER RATES MAY BE SIMPLER TO DEAL WITH BUT THEY WON’T BE LOWER THAN MY SPECIAL RATES.

1. Give me your best rate and I will give you a yes or a no

OR

2. Give me ALMOST ANY RATE but you must agree to the following terms, WHICH ONLY COLLECTIVELY APPLY TO MY SPECIAL LOW RATES OFFER:

a. Terms “b” through “k” that follow will be included in our written contract and preceded by the words “<name of your firm> AGREES TO THE FOLLOWING TERMS, HENCEFORTH COLLECTIVELY KNOWN AS ‘THE BISCONTI SPECIAL RATE TERMS’ OR SIMPLY ‘TBSRT.’”

b. The rate paid to the consultant will be no lower than $25 per hour.

c. The contract must be for a minimum of 40 hours per week.

d. You will reveal to the consultant what you are charging the client.

e. You will provide documentation proving what you are charging the client, with each paycheck.

f. At my discretion, I may reveal to the client what you are paying me and what you have told me you are charging them.

g. You cannot charge the client any more than 133% (1⅓ to be precise) of what you are charging the consultant. The table below provides some examples of maximum client fees.

h. PENALTY CLAUSE: If any of the terms making up TBSRT are violated, the consulting firm will pay the consultant $3500 above other consultant fees. The consulting firm will pay the $3500 within 5 working days of the consultant’s initial awareness of the violation. Consultant is the sole determiner of what constitutes the first day of the consultant’s awareness of the violation. The consulting firm relinquishes any and all legal recourse in regard to the payment of the $3500. The consulting firm relinquishes any and all legal recourse in regard to avoidance of payment of said $3500. In addition, regular contract earnings will be paid to the consultant, according to which is sooner, either (1) within 10 working days of the consultant’s initial awareness of the violation or (2) at the payment time dictated by the contract and/or previous payment history. (Payment time stated in the contract will supersede payment time dictated by payment history.) Furthermore, the contract will be immediately terminated and the client will be immediately notified by the consulting firm and/or the consultant of the reason(s) for the contract termination.

i. OVERRIDE CLAUSE: The terms making up TBSRT override any and all terms of any and all other contracts that the consultant has with the consulting firm.

j. LEGAL ACTION CLAUSE: The consulting firm agrees to pay the cost of any and all legal action brought against the consulting firm by the consultant as a result of the consulting firm’s violation of one or more terms of TBSRT.

k. INTERPRETATION CLAUSE: The consulting firm agrees that the consultant’s interpretation of TBSRT supersedes any differing interpretation of TBSRT held by the consulting firm and/or any other party or parties. The consultant agrees that the consultant’s interpretation of TBSRT must be within the bounds of the common use of the English language and not according to any special, including any legalistic, use of the English language.
